"Services" refers to all digital marketing offerings, including but not limited to social media followers, likes, views, comments, and engagement for third‑party platforms.
"User" means any individual or entity that registers for or uses the Services.
"Platform" means third‑party social‑media networks such as Instagram, YouTube, Facebook, Twitter, TikTok, etc.
"Content" means any text, images, videos or other material provided by you or generated through the Services.


2. Scope of Services

We offer non‑organic digital engagement (followers, likes, views, comments) for branding and visibility. You acknowledge these interactions may be bot‑generated or incentivized and do not guarantee genuine user interest, conversions, or endorsements.


3. Payment & Billing

Prepaid Services : All Services are prepaid. You must fund your www.smmbirla.com wallet prior to placing any order.

Wallet Funds : Wallet balances are non-withdrawable and cannot be returned to your original payment method under any circumstances. Funds in the wallet may only be used to purchase Services on our Site.

Fees & Taxes : All fees are exclusive of applicable taxes.

Suspension for Non-Payment : We reserve the right to suspend or cancel any order if the wallet balance is insufficient.


4. Disclaimer on Services

  • Services may employ bot‑generated or incentivized methods, which may not involve real users.

  • These engagements are cosmetic or marketing aids and do not constitute endorsement.

  • Use of Services may violate the Platform’s Terms of Service; you bear full responsibility for any account actions (suspension, removal, bans).

  • We do not represent that purchased engagement equates to genuine user activity or business results.


5. Legal Compliance & Data Protection

  1. Applicable Laws : Our operations comply with the Information Technology Act, 2000 (including Sections 43A, 79) and the Consumer Protection Act, 2019, along with ASCI and CCPA guidelines.

  2. Data Collection : We collect personal data necessary for service delivery. Our Privacy Policy explains processing and storage.

  3. Consumer Rights : You may lodge grievances with the Central Consumer Protection Authority (CCPA).


6. Intellectual Property

All content, trademarks, logos, software, and designs on the Site are owned by us or our licensors. We grant you a limited, non‑exclusive, non‑transferable license to use the Services for lawful promotional purposes.

Use of Third‑Party Trademarks
We reference social media platform names (e.g., Instagram, YouTube, Facebook, TikTok) solely to identify compatibility and functionality. All such names and logos are trademarks of their respective owners, and our use does not imply any affiliation, endorsement, or sponsorship. If any trademark owner requests removal of their name or logo from our Site, we will comply upon receiving prior written notice at support@smmbirla.com. Our use of these marks is permitted under nominative fair use provisions of applicable trademark law.


7. User Conduct & Restrictions

You agree not to:

  • Use Services for phishing, harassment, hate speech, defamation, or other unlawful acts.

  • Resell, redistribute, or bundle Services without explicit disclosure.

  • Exploit vulnerabilities, attempt unauthorized access, or reverse‑engineer our platform.


8. Indemnification

You shall indemnify, defend, and hold harmless Trickyn, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising out of or related to your use or misuse of the Services, breach of these Terms, or violation of any law.


9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any:

  • Indirect, incidental, special, or consequential damages arising from the Services.

  • Account suspensions, bans, or penalties imposed by Platforms.

  • Loss of data, revenue, or business arising from service interruptions or delays.
    All Services are provided "as is" and "as available," without warranties of any kind.


10. Force Majeure

Neither party shall be liable for delays or failures resulting from events beyond its reasonable control, including but not limited to natural disasters, strikes, wars, government action, or changes to third‑party Platform APIs.


11. Governing Law & Dispute Resolution

  1. Governing Law : These Terms are governed by the laws of the Republic of India.

  2. Arbitration : Any dispute shall first be referred to arbitration in Kolkata under the Arbitration and Conciliation Act, 1996.

  3. Jurisdiction : If arbitration does not resolve the dispute within 60 days, parties may approach the courts of Kolkata.


12. Severability & Entire Agreement

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force. These Terms, together with any documents expressly incorporated, constitute the entire agreement.


13. Refund Policy

All sales are final except where we fail to deliver the purchased Services. In such cases, we will issue service credits or refunds per Consumer Protection Act, 2019 norms.


14. Changes to Terms

We reserve the right to modify these Terms at any time by posting updates on the Site. Continued use of the Services signifies your acceptance of the revised Terms.
